PRIVACY POLICY

Applies To: Visitors, prospects, customers, claim stakeholders (e.g., insurers/adjusters), vendors/subcontractors, job applicants, and recipients of our marketing/sales communications (including SMS via A2P 10DLC) in the United States.

Plain-English commitment: We do not sell or share your personal information for third parties’ own marketing or advertising. We disclose information only to service providers/contractors under written agreements for our business purposes, or as required by law. We require them to keep it confidential and use it only to provide services to Bradway.


1) Scope & How to Read This Notice


This policy explains what we collect, why, how we use and disclose it, your choices and rights, and how to contact us. It covers our websites ([your domains]), forms, phone/email/SMS communications, field operations at project sites, customer portals, telematics/asset tracking, and recruiting. A state-specific supplement (Section 17) explains additional rights (e.g., California, Virginia, Colorado, Connecticut, Utah). A dedicated SMS Addendum appears in Section 15.


2) Key Definitions


Personal Information (PI): Information that identifies, relates to, or can reasonably be linked with a person or household (e.g., name, email, phone, IDs, online identifiers, geolocation, photos/videos).


Sensitive PI: Certain categories such as precise geolocation, government IDs, financial account numbers, health info, etc.


Sell / Share: As defined by California law—disclosing PI for monetary or other valuable consideration (sell) or for cross-context behavioral advertising (share).


Service Provider / Contractor: A third party that processes PI for us under a written contract with strict use limits and confidentiality obligations.


3) What We Collect & Sources


Identifiers: name, email, phone, postal address. Sources: you; your employer/insurer/adjuster; property managers. Purpose: quotes, scheduling, service delivery, customer care. Sell/Share: No.


Commercial information: quotes, work orders, invoices, claim numbers. Sources: you; insurer/adjuster; our systems. Purpose: project management, billing, insurance/claim handling. Sell/Share: No.


Internet/device data: IP, device IDs, pages viewed, cookies, logs. Sources: your devices; our sites; analytics tools. Purpose: site security, performance, analytics; (optional) advertising measurement. Sell/Share: No (and no targeted ads unless you opt in).


Geolocation/telematics: fleet GPS, site check-ins (staff/vehicles). Sources: fleet/telematics providers; Bradway apps. Purpose: safety, dispatch, asset management. Sell/Share: No.


Photos/video: jobsite documentation, damage/repair photos; limited CCTV. Sources: Bradway staff; subcontractors. Purpose: insurance documentation, quality/safety, progress tracking. Sell/Share: No.


HR/applicant data: resume, availability, qualifications, references. Sources: you; references; background vendors (if used). Purpose: recruiting, compliance. Sell/Share: No.


Payment data: card tokens (via payment processor), ACH info. Sources: you; payment processor. Purpose: payments, refunds. Sell/Share: No (Bradway does not store full card data).


Sensitive PI (limited): injury/claim details from insurer documents (if any). Sources: insurer/adjuster; you. Purpose: fulfilling restoration/insurance obligations. Sell/Share: No (strictly limited use).


California Notice at Collection: We collect the PI categories listed above for the purposes shown. We do not sell or share PI as defined by California law. We retain PI as described in Section 12.


4) Why We Use Your Information


Provide quotes, plan work, dispatch crews, and complete projects; coordinate with insurers/adjusters/property managers; communicate about services (email, phone, SMS—SMS requires prior opt-in); billing, accounting, audits, legal and insurance obligations; safety and security (including limited CCTV/site logs); website operation, performance, analytics, and (if enabled) advertising measurement; recruiting and HR compliance.


5) “No Sale/No Share” for Advertising


We do not sell or share your PI for third-party advertising. If we ever consider optional analytics/ads that qualify as sharing, we will present a “Your Privacy Choices” link and honor Global Privacy Control (GPC) signals. By default, Bradway does not engage in targeted advertising.


6) Disclosures to Service Providers (Not Third-Party Use)


We disclose PI only to vetted service providers/contractors that help us operate (hosting, email/SMS delivery, CRM, analytics, payment processing, telematics, legal/accounting, insurers/adjusters when you are part of a claim). Contracts forbid them from using PI for their own purposes.


7) Insurance/Claims & Project-Site Details (Industry-Specific)


Jobsite documentation: We capture photos/videos to document damage, repairs, code compliance, and quality. Content may incidentally include personal items or license plates. We restrict access and never publish such content for marketing without written permission.


Insurer/adjuster coordination: Where a claim exists, we may exchange necessary documents and photos with your insurer/adjuster solely to process and validate the claim.


Subcontractors on site: Subcontractors may access limited PI needed to perform work; they are bound by confidentiality and use limits.


8) Cookies, Pixels & Global Privacy Control


Cookies/trackers: We use essential cookies for site functionality and security; optional analytics/measurement may be used to improve services.


Preference center: If optional cookies are enabled, we provide a banner and settings to opt in or out.


Do Not Track/GPC: We treat user-enabled Global Privacy Control signals as a request to opt out of any sale/share and apply it to the browser/session and, where feasible, to your account.


Ad pixels (optional): If used, we label them and provide opt-out. By default, Bradway does not use targeted advertising.


9) Email Marketing (CAN-SPAM) & Calls


Email: Every marketing email includes a working unsubscribe link; opt-out requests are honored within 10 business days. We do not require a fee, additional information beyond an email address, or any steps beyond a reply email or a single web page to submit an opt-out.


Call recording (where permitted): If we record customer-care calls for quality/training, we provide notice and honor applicable state rules.


10) A2P 10DLC SMS/MMS (Summary)


We only text individuals who explicitly opt in. Enrollment requires clear, conspicuous disclosures identifying Bradway, describing message types and frequency, stating that message/data rates may apply, providing STOP/HELP instructions, and linking to this policy and our Terms. Consent is not a condition of purchase. See Section 15 for full terms.


11) Sensitive Personal Information


We avoid collecting Sensitive PI. If limited Sensitive PI appears in claim documentation (e.g., injury details), we use it only to fulfill the claim/project, apply heightened safeguards, and never for marketing.


12) Retention


We retain PI only as long as necessary for the purposes described or as required by law:


• Project/claim files: typically [X] years after completion/settlement

• Marketing/SMS logs: while consent is active and [X months] after opt-out for compliance/audit


When no longer needed, we delete or de-identify the data.


13) Security


We apply reasonable administrative, technical, and physical safeguards: role-based access, encryption in transit, secure configurations, vendor due diligence, workforce training, and incident response procedures. No system is perfectly secure; we will notify you as required by applicable breach laws.


14) Children


Our services are not intended for children under 13. We do not knowingly collect their PI.


15) SMS (A2P 10DLC) Addendum


Opt-In Required: We text only after clear, affirmative consent via web form checkbox, text-to-join keyword, or similar enrollment that names Bradway, describes message types/frequency, includes STOP/HELP, and links to this policy and our Terms. Consent is not a condition of purchase.


Confirmation Message: Sent before recurring texts begin and includes program name/description, HELP contact, STOP instructions, frequency disclosure, and a 'Msg & data rates may apply' notice.


Opt-Out Anytime: Reply STOP to cancel; HELP for help. We promptly honor opt-outs and maintain an internal do-not-contact list. Under FCC rules, recipients may revoke consent by any reasonable method that clearly expresses a desire to stop texts.


No Third-Party Use: We do not sell or share SMS subscriber data. Limited transmission to carriers/processors occurs solely to deliver the messages; those parties are bound to confidentiality and use limits.


Records: We keep verifiable consent logs (timestamp, method, disclosures shown) for audit/carrier review.


Message Frequency & Rates: Frequency varies; Msg & data rates may apply.

16) Payments


Card data is processed by a PCI-compliant payment processor. Bradway does not store full card numbers or CVV codes.


17) Your U.S. State Privacy Rights


Depending on your state, you may have rights to access/know, correct, delete, and obtain a portable copy of your PI, and to opt out of sale, sharing/targeted advertising, or certain profiling. We do not sell/share PI, but we honor valid opt-out requests.


How to exercise: See Section 21. We verify your identity and respond within the applicable timeframes. Authorized Agents (CA): We honor requests submitted by authorized agents with appropriate proof. Appeals (e.g., CO/VA): If we deny a request, you may appeal using the instructions in our response. We will not discriminate against you for exercising your rights.


18) De-Identified & Aggregated Data


We may create de-identified or aggregated data for analytics and service improvement. We commit to maintain it in a de-identified state and not to re-identify it.


19) International Users


We operate in the United States. If you access our services from outside the U.S., your data may be processed in the U.S. where laws may differ.


20) Changes to This Policy


We may update this policy. Material changes will be posted with a new effective date and, where required, notified to you directly.
